New prerequisites for visas and residence permits for French spouses: A Quick and Practical Overview Discover these changes and how they directly affect administrative procedures.

As part of a project to update the CESEDA (Code de l'Entrée et du Séjour des Étrangers et du Droit d'Asile), the Commission Mixte Paritaire has adopted a number of significant changes to article L. 423-1, redefining the conditions for obtaining visas and residence permits for spouses of French nationals.

Here are the key points of these adjustments:

  • Applicants will now have to demonstrate that their resources are stable, regular and sufficient;
  • They will have to prove that they have or will have a home that is considered "normal";
  • They must prove that they are covered by health insurance for the duration of their stay in France.

These enhanced criteria are designed to ensure that beneficiaries of visas and residence permits are able to support themselves independently. The specific details concerning the implementation of these new conditions will be defined by decree in the Conseil d'Etat, providing clear legal guidance for applicants and the relevant authorities.
